Terms & Conditions for Flowers by Patricia Online Orders
Introduction
These Terms and Conditions set out the basis on which Flowers by Patricia supplies products and services to you when you place an order for flowers, plants, gifts or related items via our online shop. By placing an order, you agree to be bound by these Terms and Conditions, which are designed to comply with applicable consumer protection and e-commerce laws in the United Kingdom.
These Terms and Conditions apply to all online orders placed for delivery in Patricia and the surrounding areas, as specified during the checkout process. Please read them carefully before submitting your order, as they explain your rights and responsibilities, as well as ours.
If you do not agree with any part of these Terms and Conditions, you should not proceed with placing an order through our website.
Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
"We", "us" and "our" refer to Flowers by Patricia as the retailer and supplier of the products and services offered through our online shop.
"You" and "your" refer to the customer placing an order through our online shop.
"Products" means flowers, bouquets, arrangements, plants, gifts, and any other items offered for sale on our website.
"Order" means an order placed by you for products via our online checkout process.
"Delivery area" means Patricia and the surrounding areas in which we agree to deliver products, as indicated on our website or at checkout.
Eligibility to Purchase
By placing an order through our website, you confirm that you:
• are at least 18 years of age;
• are legally capable of entering into a binding contract;
• are a resident of, or are arranging delivery to, an address within our delivery area; and
• will provide accurate and complete contact and delivery information.
Order Process
To place an order, you will be required to select your chosen products, provide delivery details, select a delivery date (where available), and complete payment through our secure online checkout. You are responsible for ensuring that all information provided is correct, including the recipient’s name, delivery address, contact details, and any personalised message.
After you submit your order, you will receive an order confirmation on screen and, where applicable, by electronic confirmation. This confirmation acknowledges that we have received your order but does not constitute acceptance of your order or guarantee availability of the products.
Acceptance of your order, and the formation of a binding contract between you and us, will occur when we confirm that your order has been processed and is being prepared for dispatch or collection. We reserve the right to refuse any order prior to acceptance, for example, if products are unavailable, if there is a pricing or product description error, or if we reasonably believe the order may be fraudulent or in breach of these Terms and Conditions.
If we are unable to accept your order, we will inform you as soon as reasonably possible and, where payment has been taken, we will arrange a refund of the relevant amount using your original method of payment.
Product Description and Substitutions
We make every reasonable effort to ensure that the descriptions and images of our products on the website are accurate and up to date. However, flowers and plants are natural products and may vary in colour, size, and shape from images shown. All images are for illustrative purposes only.
In the event that certain flowers, foliage, containers or accessories are unavailable on the day of preparation, we reserve the right to substitute items of equal or higher value and similar style, ensuring that the overall appearance and quality of the arrangement are maintained. Substitutions may be particularly necessary during peak seasonal periods or due to supply conditions beyond our control.
If a key feature of the product must be changed substantially, we will take reasonable steps to contact you before dispatch. If you do not accept the substantial substitution, you may be entitled to cancel the order and receive a refund.
Prices and Payments
All prices for our products are shown in pounds sterling (GBP) and are inclusive of any applicable VAT, unless otherwise stated. Delivery charges, if applicable, will be clearly indicated during the checkout process before you confirm your order.
We reserve the right to change prices, delivery charges, and promotional offers at any time. Any such changes will not affect orders which have already been accepted.
Payment for orders must be made at the time of placing the order using one of the payment methods made available at checkout. By submitting your payment details, you confirm that you are authorised to use the chosen payment method and that the payment information provided is accurate and complete.
Your payment will normally be processed at the point of order. If, for any reason, we are unable to collect payment, we may cancel your order and will inform you accordingly.
Delivery
We offer delivery within Patricia and surrounding areas as indicated on our website. Not all products may be available for delivery to all addresses, and we reserve the right to refuse delivery to an address outside our stated delivery area.
During checkout, you may be offered a choice of delivery dates and, where applicable, time slots. We will take reasonable steps to deliver on your selected date; however, delivery dates and times are not guaranteed, and we will not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to traffic conditions, weather, public holidays, or third-party courier delays.
It is your responsibility to ensure that someone is available at the delivery address to receive the order. If no one is available, we may, at our discretion, leave the flowers in a safe place, with a neighbour, or follow any specific delivery instructions provided by you at checkout. In such cases, delivery will be deemed completed and we will not be responsible for any loss, damage, or theft occurring after the delivery has taken place.
If we are unable to complete delivery because of an incorrect address, inaccessible premises, or lack of contact details, we may attempt to contact you for further instructions. Where redelivery is required or the order is returned to us, we may charge an additional delivery fee. Perishable products such as fresh flowers cannot always be redelivered in the same condition, and we will not be liable for deterioration arising from failed delivery attempts that are not our fault.
Click and Collect (Where Available)
Where a collection option is offered, you may choose to collect your order from our premises at a specified date and time. It is your responsibility to collect the order within the agreed collection window. If you fail to collect the order on the agreed date, we cannot guarantee the quality of perishable products, and no refund will be due in these circumstances.
Cancellations and Amendments
Because flowers and related items are often prepared to order and are perishable, your statutory right to cancel under distance selling regulations may be limited in certain circumstances.
You may request cancellation or amendment of your order by contacting us as soon as possible after placing it. We will endeavour to accommodate your request provided that preparation or dispatch has not yet begun. If the order has already been prepared, arranged, or dispatched, cancellation or major amendment may not be possible, and no refund may be due.
If we agree to cancel an order prior to preparation, we will arrange a refund of the order value (less any non-refundable fees notified to you at the time of ordering) using your original method of payment within a reasonable period.
In the event that we are unable to fulfil your order due to stock issues or other reasons within our control, we may offer you the choice of a full refund or a suitable alternative product of equal or greater value.
Returns, Refunds and Quality Concerns
We are committed to delivering high-quality flowers and products. If you are unhappy with the quality or condition of the products received, you should contact us as soon as reasonably possible, ideally within 24 hours of delivery or collection, so we can assess the issue and, where appropriate, put matters right.
Because flowers and plants are perishable, you may be asked to provide clear evidence of the issue, such as photographs, and we may give you specific care instructions that should be followed. Failure to follow basic care instructions (such as trimming stems, using fresh water, and keeping arrangements away from heat sources) may affect your right to a remedy.
Where we agree that the products are faulty, damaged, or not as described, we may offer one or more of the following remedies at our discretion, taking into account your statutory rights: a replacement product, a partial refund, a full refund, or a credit towards a future purchase.
We generally do not accept returns of fresh flowers and plants due to their perishable nature, except where required by law or as part of an agreed remedy for faulty products.
Customer Obligations
You agree to provide accurate and complete information when placing an order, to ensure that the recipient will be available to receive the delivery where possible, and to follow any reasonable care instructions provided with the products.
You undertake not to use our products for any unlawful purpose and not to resell products purchased from us in the course of business without our prior consent.
Liability
Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be limited or excluded by law.
Subject to the above, we shall not be liable for any loss or damage that is not foreseeable, indirect or consequential, including but not limited to loss of profits, revenue, business, or goodwill. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the contract.
Our total liability to you for any loss or damage arising out of or in connection with any order shall be limited to the total price paid by you for that order.
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events or circumstances beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, lock-outs, industrial disputes, breakdown of systems or network access, or actions of third parties.
Personal Data and Privacy
We will collect and process personal data you provide to us in the course of placing and fulfilling your order. This may include your name, contact details, delivery address, payment details, and any information you choose to include in personalised messages.
Your personal data will be handled in accordance with applicable data protection laws in the United Kingdom. We will use your information for purposes including processing your order, arranging delivery, customer service, and, where permitted, marketing communications. Further details about how we handle your personal data are set out in our privacy information, available on request.
Intellectual Property
All content on our website, including text, images, logos, and designs, is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use any such content for commercial purposes without our prior written consent.
Changes to These Terms and Conditions
We may update these Terms and Conditions from time to time to reflect changes in our business practices, legal requirements, or customer feedback. The version of the Terms and Conditions that applies to your order will be the version displayed on our website at the time you place your order.
We recommend that you review these Terms and Conditions each time you place an order to ensure that you understand the terms that will apply.
Governing Law and Jurisdiction
These Terms and Conditions, and any contract between you and us, are governed by and shall be construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales will have exclusive jurisdiction over any disputes or claims (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions, your order, or the use of our online shop.
Territorial Application
These Terms and Conditions apply to customers placing orders for delivery within Patricia and the surrounding areas only, as specified in our delivery information and at checkout. We do not accept responsibility for orders placed for delivery outside this defined area unless expressly agreed in advance.
By placing an order with Flowers by Patricia, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
